1. Acceptance of Terms
By accessing or using the services provided by Patchwerk Technologies (“Patchwerk”, “we”, “us”), including our website, APIs, custom extraction services, and pre-extracted datasets (collectively, the “Services”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our Services.
2. Description of Services
Patchwerk provides data infrastructure services, including the delivery of pre-extracted public datasets and bespoke data extraction engineering. We collect publicly accessible data, honor standard web scraping protocols (such as robots.txt where applicable), and respect per-source rate limits.
3. Acceptable Use
You agree to use the Services and any data provided by Patchwerk only for lawful purposes. You shall not use our data to:
- Violate any applicable local, state, national, or international law or regulation (including GDPR and CCPA).
- Engage in unsolicited spamming, phishing, or harassment.
- Train generative AI models in violation of the original data source’s explicit copyright or intellectual property rights.
- Attempt to re-identify anonymized data or circumvent any privacy protections.
4. Intellectual Property
Patchwerk claims no intellectual property ownership over the raw facts or publicly available data contained within our datasets. We do claim copyright over the specific compilation, schema organization, and structural formatting (the “Database”) we engineer. You are granted a non-exclusive, non-transferable license to use the structured datasets for your internal business purposes.
5. Disclaimers and Limitations of Liability
A. “AS IS” Provision: The Services and datasets are provided on an “AS IS” and “AS AVAILABLE” basis. While we strive for accuracy, Patchwerk makes no warranties, express or implied, regarding the completeness, accuracy, reliability, or availability of the data.
B. Limitation of Liability: In no event shall Patchwerk Technologies be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or related to your use of the Services.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
